TERMS OF SERVICE
The owner of the online store TheRollingTomes.com (hereinafter referred to as the Online Store) is The Rolling Tomes OÜ (registry code 17243273), with its registered address at Sõle 75-2, Tallinn, Estonia.
Validity of the Sales Agreement, Product, and Pricing Information
The terms of sale apply to purchases made from the Online Store.
The prices of the products sold in the Online Store are indicated alongside the products. Additional fees may apply for the delivery of goods. The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing the order. Information about the goods is provided directly alongside the products in the Online Store.
Placing an Order
To place an order, the desired products must be added to the shopping cart. To finalize the order, the required data fields must be completed, and a suitable delivery method must be selected. The total cost will then be displayed on the screen and can be paid via a bank link. The agreement enters into force upon receipt of the payable amount in the Online Store’s bank account. If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded without delay but no later than within 14 days of the notification.
Delivery
Goods are delivered to the following countries: Estonia, Latvia, Lithuania.
The cost of delivery is borne by the buyer, and the relevant pricing information is displayed alongside the delivery method.
Shipments generally reach the destination specified by the buyer within 3–7 business days after the sales agreement takes effect. In exceptional cases, the Online Store reserves the right to deliver the goods within 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the agreement concluded in the Online Store within 14 days. The right of withdrawal does not apply if the buyer is a legal entity.
To use the 14-day return right, the ordered goods must not be used in a manner other than necessary to verify the nature, characteristics, and functioning of the goods in the same way as would be allowed in a physical store. If the goods have been used for purposes other than necessary to determine their nature, characteristics, and functioning, or if they show signs of use or wear, the Online Store has the right to reduce the refundable amount in accordance with the diminished value of the goods. To return goods, a withdrawal application must be submitted and sent to the email address provided within 14 days of receiving the goods. The costs of returning the goods are borne by the buyer, except in cases where the reason for return is that the goods do not correspond to the order (e.g., wrong or defective goods). The buyer must return the goods within 14 days after submitting the withdrawal application or provide proof that the goods were handed over to the carrier within that period. Upon receiving the returned goods, the Online Store will immediately refund all amounts paid by the buyer under the agreement, but no later than within 14 days of receiving the withdrawal application.
The Online Store may refuse to make refunds until it has received the goods being returned or until the buyer provides proof of having returned the goods, whichever occurs first. If the buyer explicitly chooses a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the cost exceeding the standard delivery cost. The Online Store reserves the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store was mistakenly listed significantly lower than the market price due to an error.
Right to File a Complaint
The Online Store is responsible for the non-compliance or defects of goods sold to the buyer that existed at the time of delivery and which become apparent within two years of delivery to the buyer. During the first six months after delivery, it is presumed that the defect existed at the time of delivery. The Online Store is responsible for disproving this presumption. The buyer has the right to contact the Online Store regarding defects within two months of discovering the defect by sending an email to hello@therollingtomes.com. ˇThe Online Store is not responsible for defects that occur after the goods have been delivered to the buyer. If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund all fees associated with the sales agreement to the buyer. The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses personal data provided by the buyer (including name, phone number, address, email address, and bank details) only for processing orders and delivering goods to the buyer. The Online Store forwards personal data to transport service providers to ensure the delivery of goods. The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed consent by entering their email address on the website and opting to receive direct marketing messages. The buyer can unsubscribe from newsletters and offers sent to their email at any time by notifying the Online Store via email or by following the instructions provided in an email containing an offer.
Dispute Resolution
If the buyer has complaints regarding the Online Store, they should be sent to hello@therollingtomes.com. If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The conditions for proceedings and submission of applications are available here. The Consumer Disputes Committee is authorized to resolve disputes arising from agreements concluded between the buyer and the Online Store. Reviewing a buyer’s complaint by the Committee is free of charge. The buyer may also turn to the European Union’s online dispute resolution platform.
